Trademark Questionnaire

How to Start: In order to start the application process, we need information from you. Rest assured, this information is kept completely confidential. The information collected is for us to find our your particular needs and to assist us in determining how best to proceed with protecting your trademark.
Once we have the information from you, we will prepare our "Confirmation Instructions". This document will clearly set out what we need from you in order to file your mark. After reviewing our "Confirmation Instructions" and providing us with what is needed, we are then ready to file your application immediately.
We work with agents and attorneys strategically located around the world to provide you with prompt and efficient regsitration of your trademarks. Many of our foreign associates are directly linked with us and we work together completely electronically in order to expedite the filing, prosecution and maintenance of these applications.

What Countries: From our many years of working with international trademark protection, we prepared a List of Trademark Jurisdications which lists all of the countries in the world where trademark protection is possible. The list has been organized into four categories as follows:

  1. Commercially Important Countries : Those countries that are typically important and where often business is conducted.
  2. First to File Countries: In many countries, the person that first files a trademark has paramount rights. These countries are listed.
  3. First to Use Countries: In many countries (typically Britsh Law Countries), the person that first uses a trademark has priority of right. However, it is often necessary to register your mark in order to protect it and prosecute infringements.
  4. Later Filing: These are countries of seemingly lower importance from a commercialization view point, and/or require the use of another countries' registration in order to file in that country.

You can view this list by clicking here, or downloading either the PDF or Word versions for future reference.

Note that the following countries will be part of the EEC effective May 1, 2004: Czech Republic, Estonia, Cyprus, Latvia, Lithuania, Hungary, Malta, Poland, Slovenia and Slovakia.
Forms Required for filing trademarks in Foreign Countries: Each country has different requirements and we will provide you with details once we have your information.

We provide convenient ways to provide us with information:

  Summary of Charges:
Foreign Filings: The charges and requirements for each country are different. Kindly complete the questionnaire and we will provide you with more specific information regarding your request. We will provide you with a flat rate quote to file your application which will include our fees, our associate fees and government fees for filing. In most countries, the application will be examined and often we will incur additional charges to "negotiate" the acceptance of your mark. In most countries, applications are approved and then published for opposition so third parties may have an opportunity to object to registration of your mark. Also, in most countries, once a trademark application is accepted, it is necessary to pay additional fees to have the trademark registration issued. Each of these charges will be billed to you as they are incurred.
