How do I find out whether a mark is already registered?
  You need to conduct a search in the countries of interest.  
Generally, what is the trademark application process?  
 

We are experts here to assist you in filing and registering your trademarks. To start the filing process for either United States or Foreign trademarks, please click the link. The process is generally as follows:

  • We receive information from you about your mark and the countries of interest
  • We process that information and provide you with our "Confirmation Instructions" which details what we understand you need for us to do, what we need from you in order to start the process, details on fees and any additional information as may be necessary to start representing you.
  • Application is filed.
  • It is then examined by the trademark office to determine if the mark is registrable. They usually will return with objections, some are significant, others are minor.
  • Being versed in the laws in many countries, we either take care of what we can, or ask for additional information or documentation from you, in order to respond.
  • A response is filed.
  • If all is in order, the application is approved for publication. This gives third parties an opportunity to object to registration of your mark. The opposition periods vary in length by country.
  • If the mark passes through the opposition period, it is registered.
  • At various different times, it is necessary to maintain or renew the registered mark. Each country has different requirements.
