PILATES STUDIO HELD GENERIC BY THE TRADEMARK OFFICE

The PMA filed an opposition against Pilates, Inc. to prevent them from again registering PILATES STUDIO after the District Court had determined that the mark was not registrable. We filed a Motion for Summary Judgment and on July 9, 2004, the TTAB issued its decision agreeing that PILATES STUDIO is generic for facilities that teach the Pilates method of exercise. The TTAB declined to rule on the remaining grounds alleged in our motion.

Authentic Pilates Litigation

 
 

The PMA filed an opposition against Pilates, Inc. to prevent them from registering AUTHENTIC PILATES. We first filed an opposition in the end of December, and in light of some recent case law, we filed an amended complaint along with a motion. Pilates, Inc. never responded to our revised complaint or the motion, but filed an answer to the original complaint.
